In this privacy statement we inform you on how your Personal Information is collected, used and shared when you use the Enkode web application (the “App”). The App is accessed free of charge, as a complementary service associated with the purchase of an Enkode wine bottle from a third-party retailer, through a QR code in the label of the bottle. The App allows users to send and receive greeting messages via a unique code generated by the App.

The data Subject is the App user.

The processing of Personal Information in the context of communicating with you is carried out under the responsibility of MAES Ventures (Data Controller), located at Via Adige 55, 20871 Vimercate, Italy.

When you use the App, we automatically collect certain information about how you interact with the App. This includes:

• User-Generated Content (UGC): Messages and other content you generate while using the App, which are transmitted through the unique codes generated by the App. 

User-generated content may contain personally identifiable information if you voluntarily include such details in your messages. Any personal identifiers included in your messages will be treated as Personal Information.

3.How do we use your Personal Information?

We do not actively monitor or process the content of your messages (UGC) unless required by law, or to ensure the App functions properly, or to address technical issues. If your messages contain personally identifiable information, it will be treated as Personal Information under this Privacy Policy.

We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful requests for information we receive, or to otherwise protect our rights.

Particularly, we ensure that third parties processing Personal Information on our behalf comply with all applicable laws and maintain appropriate safeguards to protect your information.

5.Cross-Border Data Transfers

Personal Information collected by this App may be transferred to, and stored at, a destination outside your country of residence. MAES Ventures will regularly evaluate whether the technical and organizational security measures taken, still constitute an appropriate and adequate level of security or whether additional measures are required to ensure the protection of Personal Information.

We will maintain your Personal Information for as long as is necessary to fulfil the purposes for which it was collected or as required by applicable laws and regulations, unless and until you ask us to delete this information.

You have the right (during the period of data retention) to request access to, correction, deletion and restriction of any personal data we hold about you. You also have the right to withdraw consent at any time or request the restriction of the processing of your personal data or object to how we use it as well as the right to data portability. This App is not intended for individuals under the age of 18. We do not knowingly collect or process personal data from individuals under 18. If you are under 18, please do not submit any personal data through the App.
